In May 2010, when Scott Walker learned one of his employees was promoting his gubernatorial campaign on county time, he told his staff in the Milwaukee County executive’s office that it could not happen again.

Internal documents collected as part of a criminal investigation show county staffers then ditched a secret wireless router that had allowed them to trade campaign-related emails from their personal laptops without leaving traces on the county’s computer system.

But they and Walker continued to use private email accounts to conduct campaign business during regular work hours, a State Journal review of more than 28,000 pages of emails released Wednesday shows.

Even county business was conducted largely on private emails, often with the Friends of Walker campaign staff included. Hiring and firing decisions, crafting the county budget and responding to several crises during his 2010 run for the governor’s office all were coordinated between Walker’s campaign and county staff.

The emails released Wednesday were used to prosecute Kelly Rindfleisch, Walker’s deputy chief of staff who pleaded guilty to felony misconduct in office in October 2012 for doing

campaign fundraising during the time she was receiving a county paycheck. Rindfleisch is appealing her conviction, arguing that prosecutors used unconstitutionally broad search warrants and subpoenas. The records were released as part of that appeal after the State Journal and other media outlets sought them.

Five other Walker aides and associates were also convicted of various crimes. Walker was not charged.

The blurred lines existed both before and after Walker ordered staff to stop campaigning on county time when his constituent services director, Darlene Wink, was discovered on May 13, 2010, to have been posting pro-Walker comments online while at work.

She resigned and later pleaded guilty to two counts of political solicitation by a public employee.

Before and after that time, email exchanges show Walker campaign staff directed county staff to collect information for them, some of which was done during county work hours, although many of the requests were sent early in the morning or late at night, outside of work hours.

State law prohibits anyone from soliciting or receiving any contribution or service for any political purpose during “established hours of employment or while the (government) officer or employee is engaged in his or her official duties.”

On March 16, 2010, after his campaign staff flagged an upcoming article about the Milwaukee airport as an opportunity to promote himself, Walker told his campaign team that “Fran” could put together research for the article.

Campaign communications director Jill Bader then asked county spokeswoman Fran McLaughlin and then-deputy chief of staff Tim Russell to put together information in response to a reporter’s question. She followed up the next morning at 9:47 a.m.

“Fran and Tim — can you please gather of the materials Scott references below?” Bader wrote in an email also sent to Walker. “The sooner, the better.”

On March 29, Walker asked campaign staff and Russell in the same email for a county report that would help Walker’s campaign. “The sooner, the better (if they exist),” Bader wrote in a follow-up email asking for additional documents.

“I will get on this one first thing this am,” Russell responded to Bader, Walker and others from the campaign the next morning at 6:05 a.m.

On May 13, Walker sent an email to both campaign and county staff at 6:22 a.m. suggesting the use of county resources to attack Milwaukee Mayor Tom Barrett, his eventual opponent in the gubernatorial election.

“We need to go after Barrett on the water rate hike,” he wrote. “How about a letter to the Mayor calling on him to halt the water rate hike? It can come from the CE office and be given to the public.”

Later, chief of staff Tom Nardelli suggested and Walker agreed the letter should remove a reference to Barrett’s candidacy for governor.

“We shouldn’t be using such references from our office,” Nardelli wrote to county and campaign staff.

Dozens of emails showed Walker coordinating routine county business from his campaign email at various hours of the day.

In some cases, he communicated solely with county staff. In others he answered questions, critiqued media reports, coordinated schedules and talked strategy with both county and campaign staff.

For example, on May 31, Walker traded emails with his county and campaign staff to get information to counter a story that the county parks were littered with trash.

“I’m assuming the dems have called all the stations trying to pitch this story and that they’ve taken more pics and videos of trash all day long,” Bader wrote in an email addressed to both campaign and county staff.

On July 1, Walker sent an email at 1:21 p.m. asking Cynthia Archer, head of the Department of Administrative Services for Walker, to do research for him to counter a coming negative attack by his primary challenger, Mark Neumann. “Get me all the facts I can get on the debt,” Walker wrote.

Boyd McCamish, executive director of AFSCME District Council 48, which represents about 80 percent of Milwaukee County employees, said the emails are “validation of what we’ve known for many years.”

“If people aren’t prosecuted, then what does this say about this place?” McCamish asked. “If this suddenly becomes acceptable behavior, then what does that say about Wisconsin or America?”

Assembly Speaker Robin Vos, R-Rochester, said Thursday that if something was done wrong, then those people would have been prosecuted.

“What was done by staffers on public time was wrong,” Vos said. “Nobody wants to say that we would condone people doing things that are wrong. At the same time, the release of all these emails is kind of old news in a lot of ways.”

District Attorney John Chisholm said in March 2013 that the probe had not uncovered sufficient evidence of additional wrongdoing beyond the six people charged.

“After a review of the John Doe evidence, I am satisfied that all charges that are supported by proof beyond a reasonable doubt have now been brought and concluded,” Chisholm, a Democrat, said in a statement.

Walker was traveling to Washington, D.C., on Thursday for the National Governors Association. His campaign did not respond to questions about the emails.

That email exchange is a FELONY under state and federal laws. It might not rise to the level of what Chisholm believes he needed for a beyond reasonable doubt conviction, but it will be another brick in the house that Eric Holder is building in the Five Counties. Holder has seven years to finish that house and it's going to be a beaut. Besides, it will sound great being repeated along with the rest of these 28,000 during the campaign trail. Reporters will be asking him every time he's out in the public if he wasn't lying about knowing what his campaign and county staff were doing, why are they emailing each other on co-mingled business, with him as both recipient and sender? Tim Russell, appointed by Milwaukee County Executive Scott Walker (R) as Deputy Chief of Staff and Housing Director pled guilty during Operation Freedom to diverting more than $21,000 to his personal bank account.[204]

Kelly Rindfleisch, appointed by Milwaukee County Executive Scott Walker (R) pled guilty to felony Misconduct in Public Office and was sentenced to six months in jail after admitting to campaigning for Republicans while working in Walker's Milwaukee County office.[204]

There is an ugly undercurrent to these "new" revelations that spell serious trouble for Scott Walker.

Before the first John Doe investigation was concluded, Scott Walker squirmed through by saying he was prohibited from discussing it. No more. The emails have been dumped and there are a lot of questions about his role. Walker can't hide behind a gag order any more.

The Journal Sentinel said as much this morning. Eventually, Walker will have to come back to the state and answer questions and every local reporter wants to be the next "Bridgegate" wunderkind. Walker's days of getting a pass by the press may be over thanks to his good buddy, Chris Christie.

The emails are still being mined for information. Just this morning the Progressive reported on an explicitly stated "voter caging" effort organized by Rindfleisch. There's the "no one cares about crazy people" remark from Rindfleisch regarding events at the County Mental Health Division - in addition to the really ugly office chatter that seemed to be routine under Walker's supervision.

Singularly, One item alone may not be the last straw for voters. However, taken cumulatively, they build towards a corrupt critical mass - even if you don't know exactly what voter caging is. Hint: it's illegal.

Originally, voters liked Walker's brown-bag, Eagle Scout style. If you asked them why, they couldn't be specific - it's a vibe. Now, that brown-bag has gone sour and smells a bit like bad baloney and it's a long way to November with bad job numbers and failed promises. The vibe works in reverse too.

Lastly, these aren't the only emails in the original John Doe investigation. They've got all kinds of emails which have yet to be released and don't forget about John Doe II. The investigations aren't over for Scott Walker and whether he is ever charged or not - eventually the public will hold him accountable for the people he surrounded himself with.

If Anyone out here is naive enough to think that Scott Walker is the only politician or public official to have a secret email system to circumvent the open records they are crazy. He didn't invent the Wheel. Dems get off your high horses and heads out of the sand. They are all doing it. I'm not making excuses or trying to condone it, but it's reality. While open and transparent governemnt is a good thing, these open records laws over-reach. We should have Full access to official meetings and everything In-session, but to record everything in every office is crazy. If you took a look at every email I've every sent at work I'm sure there are plenty of things I wouldn't want plastered on teh front page. I doubt I'm alone.

We do know that Sarah Palin, when she was Governor of Alaska, used private email to conduct public business (we know that because some kid hacked the account, and got in a lot of trouble for it).

We also know that when Chuck Chvala was caught using public resources for Democratic campaigning, the Democratic Dane County DA took this offense very seriously and had him sent to prison for a while. (Chvala's Republican counterpart in the Assembly went to the Republican DA of Waukesha Country and cut a plea deal that resulted in the lightest possible slap on his wrist.)

If you know of Democrats who have been running political campaigns out of the government offices and using private email to cover their tracks, you really should come forward with the evidence.

Tom Barrett was not a candidate in spring 2011 when Kris Barrett sent three emails from her MPS email account- two to her elected representatives asking them to oppose Act 10- and one to some other teachers encouraging them to go to a rally.

Therefore, no campaigning was involved in her email use, though it may have violated the MPS IT policy about sending personal messages from school accounts.

Maybe that's why the wise advise was always to never to put anything in an Email that you would not want to see publshed in the media. Even clandestine networks can eventually leak, via court proceedings or via whistleblowers.

The response that "everyone does it" does not mean you can ignore it. This is NOT supposed to be business as usual. A public official or his staff that are conducting public business or mananging a campaign under the law governing it, must make all communications that fall under the public's right to know capable of the public being able to access it. Your opening paragraph is interesting in that it assumes that Walker did not know about campaign activities before Darlene Link was caught.

It also fails to mention the fact that SKW's order came after Darlene Link's campaign work became public.

One could assume that SKW told his staff to stop the campaign work only because they got caught.

Either way the timing is ambiguous. Rather than express this ambiguity, the story just gave Walker the positive spin.

With the Appeal of the Felony charge against Kelly Rindfleisch and her requests to keep the emails sealed- this was a excellent move to allow the citizens of Wisconsin to see the under belly of the politics in the Walker Community. Who do you really think is supporting Rindfleisch's appeal and demanding the seal to remain in place on the e-mails? But just remember this- Rindfleisch's Plea agreement included an agreement to cooperate with the investigation. She is not the only name(s) out there that appeared to be very useful to the investigation thus the parallel John Doe #2 was started. Remember Rindfleisch's name from approx ten years ago involving a huge investigation which resulted in a handful of people going to jail in Madison?? Interesting in the fact that the Walker Supporters are poking fun of the "old news issue" emails but remember the felony activity has a seven year window of opportunity for prosecution !!! Hey Walker supporters - what about your publishing each and every signature on the Walker recall forms and using them as "issues" of individuals who indeed signed them ???????????

There are 14.5 million union workers in the US (2013 numbers). Plus Mr. Soros makes that 14,000,001. You are counting that number against the Koch brothers, numbering a grand total of 2. Of course they would spend more than the Koch brothers. But let's break the numbers down even further. If you divide by 10 (you said they spent 10 times that of the kochs. Then you should say this:

The Koch brothers are spending as much as 1,400,000 US Workers. That is a lot of money for 2 guys who do not want anything in return.

WI is a pilot state for what the US will look like under the extreme right Koch brothers control. Since their divide and conquer or hate and fear, however you like to phrase it, there hasn't been a day where we're not fighting each other.

Based on the many responses to this issue, I think it's safe to say these aren't just Walker's ethics, they are conservative ethics. These e-mails clearly show the mentality of those who work at the highest level of our state Government. They are more interested in making sure they remain in power than in serving the people. The people expect more from their Government, a lot more.

While there is no smoking gun (not thus far anyway) that clearly proves that the Governor didn't know about the private e-mail network and router, common sense dictates that there is NO way he could not have known. There are e-mails that strongly suggest that.

Even email sent during "work hours" may well have been sent during a person's lunch or break. Although you all have that "Union Mentality " not all county workers take a Noon lunch. There really is no way to truly say if these were sent while on the "county clock"

And there is also an attempt to try to blur the " secret server " issue with the "private emails" which are only Gmail or Yahoo accounts that most of you also use.

But this is the most telling quote of this entire story;

If there were any iota or shred of actually illegal activity by Walker himself, it would have resulted in charges.

I saved some of the e-mails, including the Unionista Enemies List of those who donated to Walker's Election Campaign and the list of Wisconsin businesses we good union members were supposed to boycott. These were sent by government employees, using government-owned equipment on government-paid work time.

Especially egregious was one from my union steward who upon acknowledging those facts said, "We must be careful not to do so much of this while at work." Yikes !!!

I suppose that after so many years of being a wholly-owned subsidiary of the Democrat Party, the public unionists felt "entitled" and bulletproof to any repercussions.

I'll continue to save them on my private machine, just in case I ever become the object of a political witch hunt and get subpoenaed by a partisan zealot.

The people in Wisconsin are starting to finally realize what a bunch of crooks run our state government. The Republicans are starting to feel some pushback. Some are retiring , some are softening their stances so they can be re-elected to their cushy job ,. Some , maybe a few, are thinking that it will tough to face their own grandkids and explain their actions.

No, there is nothing here that will put Scott Walker at criminal risk. But it does show that he lied about this network . And , really, that sums up who this man is. A man devoid of any honesty or decency. A person that will destroy our great state for a shot at becoming President,. His only real success is that he as "divided and conquered " the citizens of Wisconsin (his words- not mine). We have to do better than this.
